What Could Threaten Your Section 8?
Can the Housing Authority terminate my Section 8
rental assistance?
Yes, the Housing Authority can terminate your Section
8 rental assistance.
What would cause the Housing Authority to terminate
my Section 8?
The Housing Authority can terminate rental assistance
for the following reasons:
- Violation of any of the Section 8 Program Family
Obligations
- Previous eviction from public housing
- Previous termination under the Certificate or
Voucher Program
- Drug-related or violent criminal activity
- Fraud, bribery, or criminal activity in connection
with any federal housing assistance program
- Outstanding unpaid rents, vacancy loss, damage
claims or other debts owed to the Housing Authority
or to
another housing authority.
- Breach of an agreement by the family to repay
the Housing Authority for any money due the Housing
Authority
or an owner
- Failure to sign and submit forms to the Housing
Authority to obtain Section 8 Program Eligibility
verification
- If your family is participating, failure to comply
with the Family Self Sufficiency (FSS) Program Contract
of Participation
- Abusive or violent behavior toward Housing Authority
personnel
What are the Section
8 Program Family Obligations and where are they
listed?
The Section 8 Family Obligations
are Housing Authority and HUD rules for continuing
participation in the
Section 8 Certificate and Voucher rental assistance
programs. The Family Obligations are listed on the
Section 8 Housing Voucher and Certificate forms and
also on Housing Authority "Section 8 Family
Obligations" form (HAPP-149), which the family
signs at the time of program participation. To briefly
summarize the obligations, the family must:
- Provide the Housing Authority information on income,
citizenship, and Social Security numbers for all
family members and others living in the unit.
- Allow the Housing Authority to inspect the unit.
- Notify the Housing Authority when the family is
absent from the unit, is moving out, or terminating
the lease, or has received an owner eviction notice.
- Use the unit as the family's only residence
- Pay utility bills and supply appliances which
are the responsibility of the family under the lease
- Repay money owed to the Housing Authority
- Cooperate in moving when the family becomes too
large or small for the unit.
If I am terminated from the Section 8 Program, will
I be allowed to re-apply?
Yes, you will be allowed to re-apply for the Section
8 Program, but only during an open Section 8 Registration
period. When you complete your application, and after
a thorough review of your prior termination, the
Housing Authority will make a determination as to
your continued Section 8 Program eligibility.
